Dear brothers and sisters,
Whereas, the Quran ordains two witnesses for Nikah and Divorce, would such a Nikah or Talaq be valid if one of the witnesses is physically present and one is on the speakerphone listening to the proceedings and acknowledging his/her hearing the act. Now N2I Mullas disapprove of such a witness, basing their judgment on Ahadith. The question comes to mind due to the unreliability of Ahadith, and also, as there was no way the Prophet would have known about real time communication systems as present in today's world.
