Punishment for Adultery (apologies for using Yusuf Ali translation, this is an old article i wrote and needs correcting)

The Quran is quite clear that adultery is wrong for mankind

Surah 17 verse 32. do not come near to adultery: for it is a shameful (deed) and an evil, opening the road (to other evils).

We have to live by certain principles and values, not to do so would eventually lead to chaos and anarchy. Societies have destroyed themselves when they have degenerated into their primordial, animal behaviours. Adultery is one of those things which cannot at first be defined as to its “criminality”. If two people want to have physical relations then what does it matter? But when couples are freely available the very bases of a stable society, the family unit, is destroyed. Whenever this happens everything else goes out of the window. Hence, the need for some sort of punitive punishment to help prevent adultery and make it an act that should not be undertaken by righteous, good, people. Setting a moral boundary is not easy; one man’s morality is another’s immorality. Therefore, when Allah has set the punishment for the immoral act of adultery and fornication (any sexual act between two people who are not married to each other) then we have to understand the wisdom behind it and not allow our feelings about the so-called “barbarity” of the punishment to move us away from implementing it. What punishment should we have then? None? Imprisonment? Do we decide for ourselves what a crime is and what is not? Do we pick and choose the punishment according to who is in control or do we stick to one set of permanent values so that no-one can usurp our Allah give human rights? The punishment is only applied when the act is undertaken; no adultery then no punishment so the deterrent nature of this is just as important.

Surah 24 verses 2-11 The woman and the man guilty of adultery or fornication, flog each of them with a hundred stripes: Let not compassion move you in their case, in a matter prescribed by Allah, if you believe in Allah and the Last Day: and let a party of the believers witness their punishment. Let no man guilty of adultery or fornication marry and but a woman similarly guilty, or an Unbeliever: nor let any but such a man or an unbeliever marry such a woman: to the believers such a thing is forbidden. And those who launch a charge against chaste women, and produce not four witnesses (to support their allegations), - flog them with eighty stripes; and reject their evidence ever after: for such men are wicked transgressors; - Unless they repent thereafter and mend (their conduct); for Allah is Oft- Forgiving, Most Merciful. And for those who launch a charge against their spouses, and have (in support) no evidence but their own,- their solitary evidence (can be received) if they bear witness four times (with an oath) by Allah that they are solemnly telling the truth; And the fifth (oath) (should be) that they solemnly invoke the curse of Allah on themselves if they tell a lie. But it would avert the punishment from the wife, if she bears witness four times (with an oath) By Allah, that (her husband) is telling a lie; And the fifth (oath) should be that she solemnly invokes the wrath of Allah on herself if (her accuser) is telling the truth. If it were not for Allah’s grace and mercy on you, and that Allah is Oft- Returning, full of Wisdom, - (You would be ruined indeed). Those who brought forward the lie are a body among yourselves: think it not to be an evil to you; On the contrary it is good for you: to every man among them (will come the punishment) of the sin that he earned, and to him who took on himself the lead among them, will be a penalty grievous.
Punishment is also dependent upon your background. Those who had been abused by their masters and used for sexual purposes who then commit adultery are only given fifty lashes, while those who were in positions of honour and dignity would get double the punishment;-

Surah 4 verses 25-28
If any of you have not the means wherewith to wed free believing women, they may wed believing girls from among those whom your right hands possess (female slaves): And Allah has full knowledge about your faith. You are one from another: Wed them with the leave of their owners, and give them their dowers, according to what is reasonable: They should be chaste, not lustful, nor taking paramours: when they are taken in wedlock, if they fall into shame, their punishment is half that for free women. This (permission) is for those among you who fear sin; but it is better for you that you practise self-restraint. And Allah is Oft-forgiving, Most Merciful.
Allah does wish to make clear to you and to show you the ordinances of those before you; and (He wishes to) turn to you (in Mercy): And Allah is All-knowing, All-wise.
Allah does wish to turn to you, but the wish of those who follow their lusts is that you should turn away (from Him), far, far away.
Allah does wish to lighten your (difficulties): For man was created weak (in flesh).

And

Surah 33 verse 30
O Consorts of the Prophet! If any of you were guilty of evident unseemly conduct, the punishment would be doubled to her, and that is easy for Allah.

The normal punishment is clear, one hundred lashes (please note that a lash is not the same as a whip, the skin is not broken or cut with a lash) so where do our beloved scholars get the stoning to death nonsense from. The Jews used to stone adulterers to death so may be this is one source of the interpolated foreign idea. Muslims are too stupid to read a clear verse from the word of Allah that cannot be overlooked unless you are in fact not a Muslim. A “kafir” is someone who denies the truth so this means most of the Muslims are kafirs.

I will now quote from unauthentic hadith of Bukhari to justify the stoning punishment by Muslims who do not use the Quran as the “Criterion” for right and wrong. They do not reject anything that contradicts the Quran that is false, a lie and an abomination against Allah, the Quran and the last Messenger.

Volume 3, Book 49, Number 860: Narrated Abu Huraira and Zaid bin Khalid Al-Juhani:
A bedouin came and said, "O Allah's Apostle! Judge between us according to Allah's Laws." His opponent got up and said, "He is right. Judge between us according to Allah's Laws." The bedouin said, "My son was a laborer working for this man, and he committed illegal sexual intercourse with his wife. The people told me that my son should be stoned to death; so, in lieu of that, I paid a ransom of one hundred sheep and a slave girl to save my son. Then I asked the learned scholars who said, "Your son has to be lashed one-hundred lashes and has to be exiled for one year." The Prophet said, "No doubt I will judge between you according to Allah's Laws. The slave-girl and the sheep are to go back to you, and your son will get a hundred lashes and one year exile." He then addressed somebody, "O Unais! go to the wife of this (man) and stone her to death" So, Unais went and stoned her to death.

The following hadith, straight after the above libellous account, puts this to shame and is exactly what I am trying to advocate for us Muslims.

Volume 3, Book 49, Number 861: Narrated Aisha: Allah's Apostle said, "If somebody innovates something which is not in harmony with the principles of our religion, that thing is rejected."
If the religion cannot start from the base of all the teachings, the Quran, then what hope have we got to make sense of this life.

Volume 4, Book 56, Number 829: Narrated 'Abdullah bin 'Omar: The Jews came to Allah's Apostle and told him that a man and a woman from amongst them had committed illegal sexual intercourse. Allah's Apostle said to them, "What do you find in the Torah (old Testament) about the legal punishment of Ar-Rajm (stoning)?" They replied, (But) we announce their crime and lash them." Abdullah bin Salam said, "You are telling a lie; Torah contains the order of Rajm." They brought and opened the Torah and one of them solaced his hand on the Verse of Rajm and read the verses preceding and following it. Abdullah bin Salam said to him, "Lift your hand." When he lifted his hand, the Verse of Rajm was written there. They said, "Muhammad has told the truth; the Torah has the Verse of Rajm. The Prophet then gave the order that both of them should be stoned to death. ('Abdullah bin 'Omar said, "I saw the man leaning over the woman to shelter her from the stones."

This hadith has the Prophet opening the Torah, the corrupted version and not the one given to Moses, and showing a Jew where the stoning to death law was written. The Jew originally said that they should be lashed but was shown to be a liar and the couple were stoned to death by our Prophet. If the Prophet could see where the stoning to death verse was in the Torah, how was it that he could not read the punishment for adulterers written in the Quran? Had the Quran not been revealed to him? Are we Muslims so backward that we can accept without thinking hadith that turn our Prophet, a Rightly Guided Messenger of Allah, into a barbarian?

And what has the “inspired word of God”, the Bible got to say:
Deuteronomy
22:22 If a man be found lying with a woman married to an husband, then they shall both of them die, both the man that lay with the woman, and the woman: so shalt thou put away evil from Israel.
22:23 If a damsel that is a virgin be betrothed unto an husband, and a man find her in the city, and lie with her;
22:24 Then ye shall bring them both out unto the gate of that city, and ye shall stone them with stones that they die; the damsel, because she cried not, being in the city; and the man, because he hath humbled his neighbor's wife: so thou shalt put away evil from among you.
22:25 But if a man find a betrothed damsel in the field, and the man force her, and lie with her: then the man only that lay with her shall die.

Allah says clearly in the Quran what the punishment for adultery is but we copied this stoning barbarism and became a tribal paganised religion, just like the Jews.

If you want to add insult to injury then what abut the following hadith, which part of true belief and righteousness do they belong to:-

Volume 2, Book 23, Number 329:
Narrated Abu Dhar:
Allah's Apostle said, "Someone came to me from my Lord and gave me the news (or good tidings) that if any of my followers dies worshipping none (in any way) along with Allah, he will enter Paradise." I asked, "Even if he committed illegal sexual intercourse (adultery) and theft?" He replied, "Even if he committed illegal sexual intercourse (adultery) and theft."

Volume 5, Book 58, Number 188:
Narrated 'Amr bin Maimun:
During the pre-lslamic period of ignorance I saw a she-monkey surrounded by a number of monkeys. They were all stoning it, because it had committed illegal sexual intercourse. I too, stoned it along with them.

Who questioned the monkeys and have you ever seen a monkey wedding?

Volume 8, Book 82, Number 806:
Narrated Abu Huraira:
A man came to Allah's Apostle while he was in the mosque, and he called him, saying, "O Allah's Apostle! I have committed illegal sexual intercourse.'" The Prophet turned his face to the other side, but that man repeated his statement four times, and after he bore witness against himself four times, the Prophet called him, saying, "Are you mad?" The man said, "No." The Prophet said, "Are you married?" The man said, "Yes." Then the Prophet said, 'Take him away and stone him to death." Jabir bin 'Abdullah said: I was among the ones who participated in stoning him and we stoned him at the Musalla. When the stones troubled him, he fled, but we over took him at Al-Harra and stoned him to death.

Volume 8, Book 82, Number 816:
Narrated Ibn 'Abbas:
'Umar said, "I am afraid that after a long time has passed, people may say, "We do not find the Verses of the Rajam (stoning to death) in the Holy Book," and consequently they may go astray by leaving an obligation that Allah has revealed. Lo! I confirm that the penalty of Rajam be inflicted on him who commits illegal sexual intercourse, if he is already married and the crime is proved by witnesses or pregnancy or confession." Sufyan added, "I have memorized this narration in this way." 'Umar added, "Surely Allah's Apostle carried out the penalty of Rajam, and so did we after him."

(edited version) Volume 8, Book 82, Number 817: Narrated Ibn 'Abbas: In the meantime, 'Umar sat on the pulpit and when the callmakers for the prayer had finished their call, 'Umar stood up, and having glorified and praised Allah as He deserved, he said, "Now then, I am going to tell you something which (Allah) has written for me to say. I do not know; perhaps it portends my death, so whoever understands and remembers it, must narrate it to the others wherever his mount takes him, but if somebody is afraid that he does not understand it, then it is unlawful for him to tell lies about me. Allah sent Muhammad with the Truth and revealed the Holy Book to him, and among what Allah revealed, was the Verse of the Rajam (the stoning of married person (male & female) who commits illegal sexual intercourse, and we did recite this Verse and understood and memorized it. Allah's Apostle did carry out the punishment of stoning and so did we after him.
I am afraid that after a long time has passed, somebody will say, 'By Allah, we do not find the Verse of the Rajam in Allah's Book,' and thus they will go astray by leaving an obligation which Allah has revealed. And the punishment of the Rajam is to be inflicted to any married person (male & female), who commits illegal sexual intercourse, if the required evidence is available or there is conception or confession. And then we used to recite among the Verses in Allah's Book: 'O people! Do not claim to be the offspring of other than your fathers, as it is disbelief (unthankfulness) on your part that you claim to be the offspring of other than your real father

Volume 8, Book 82, Number 824:
Narrated Ash-Shaibani:
I asked 'Abdullah bin Abi 'Aufa about the Rajam (stoning somebody to death for committing illegal sexual intercourse). He replied, "The Prophet carried out the penalty of Rajam," I asked, "Was that before or after the revelation of Surat-an-Nur?" He replied, "I do not know."

There is the story of a goat eating the verses of rajm, stoning, that were intended for the Quran, while it was being “protected” under the pillow of Omar. He was at a loss as to what to do as people may have said that he put it into the Quran if he had tried to do so without this digested parchment. I am not going to quote it hear, I cannot be bothered, but this Billy goat gruff hadith from Sunan Ibne majah, vol 2, and Musnad Imam Ahmad, vol 6 is not mentioned by Bukhari so cannot be “Sahih” (truthful) like the ones quoted above!!!. If you want to believe in it then it shows that although Allah says he will protect the Quran, a goat is more powerful than the All-Mighty Creator and Sustainer of the universe!

There are incidents recorded in the Quran where people were threatened with stoning but none of them were Muslims, they were pagans. This is further proof that the practice of Islam today has more to do with idolatry than the pure Quranic way of life ordained for us by Allah.

Surah 11 verses 88-95 (concerning the Prophet Shuaib)
He said: "O my people! See you whether I have a Clear (revelation) from my Lord, and He has given me sustenance (pure and) good as from Himself? I wish not, in opposition to you, to do that which I forbid you to do. I only desire (your) betterment to the best of my power; and my success (in my task) can only come from Allah. In Him I trust, and unto Him I look.
"O my people! Let not my dissent (from you) cause you to sin, lest you suffer a fate similar to that of the people of Noah or of Hud or of Salih, nor are the people of Lut far off from you!
"But ask forgiveness of your Lord, and turn unto Him (in repentance): For my Lord is indeed full of mercy and loving-kindness."
They said: "O Shuaib! Much of what you say we do not understand! In fact among us we see that you have no strength! Were it not for your family, we should certainly have stoned you! For you have no great position among us!"
He said: "O my people! Is then my family of more consideration with you than Allah? For you cast Him away behind your backs (with contempt). But surely my Lord encompasses on all sides all that you do!
"O my people! Do whatever ye can: I will do (my part): Soon will you know who it is on whom descends the penalty of ignominy; and who is a liar, and watch you, for I too am watching with you!"
When Our decree issued, We saved Shuaib and those who believed with him, by (special) mercy from Ourselves: But the (mighty) blast did seize the wrong doers, and they lay prostrate in their homes by the morning,-
As if they had never dwelt and flourished there! Ah! Behold! How the Madyan were removed (from sight) as were removed the Thamud!

Surah 18 verses 19-20 (concerning the people of the cave)
Such (being their state), we raised them up (from sleep), that they might question each other. One of them said, "How long have you stayed (here)?" They said, "We have stayed (perhaps) a day, or part of a day." (At length) they (all) said, "(Allah) (alone) knows best how long you have stayed here.... Now send you then one of you with this money of yours to the town: let him find out which is the best food (to be had) and bring some to you, that (you may) satisfy your hunger therewith: And let him behave with care and courtesy, and let him not inform any one about you.
"For if they should come upon you, they would stone you or force you to return to their cult, and in that case ye would never attain prosperity."

Surah 19 verses 41-48 (concerning Abraham)
(Also mention in the Book (the story of) Abraham: He was a man of Truth, a prophet.
Behold, he said to his father: "O my father! Why worship that which hears not and sees not, and can profit you nothing?
“O my father! To me has come knowledge which has not reached you: so follow me: I will guide you to a way that is even and straight.
"O my father! Serve not Satan: for Satan is a rebel against (Allah) Most Gracious.
"O my father! I fear lest a Penalty afflict you from (Allah) Most Gracious, so that you become to Satan a friend."
(The father) replied: "Do you hate my gods, O Abraham? If you forbear not, I will indeed stone you: Now get away from me for a good long while!"
Abraham said: "Peace be on you: I will pray to my Lord for your forgiveness: for He is to me Most Gracious.
"And I will turn away from you (all) and from those whom you invoke besides Allah. I will call on my Lord: perhaps, by my prayer to my Lord, I shall be not unblessed."

Surah 26 verses 105-112 (concerning Noah)
The people of Noah rejected the apostles.
Behold, their brother Noah said to them: "Will you not fear (Allah)?
"I am to you an apostle worthy of all trust:
"So fear Allah, and obey me.
"No reward do I ask of you for it: my reward is only from the Lord of the Worlds:
"So fear Allah, and obey me."
They said: "Shall we believe in you when it is the meanest that follow you?"
He said: "And what do I know as to what they do?
"Their account is only with my Lord, if you could (but) understand.
"I am not one to drive away those who believe.
"I am sent only to warn plainly in public."
They said: "If you desist not, O Noah, you shall be stoned (to death)."
He said: "O my Lord! Truly my people have rejected me.
"Judge You, then, between me and them openly, and deliver me and those of the Believers who are with me."
So We delivered him and those with him, in the Ark filled (with creatures).
Thereafter We drowned those who remained behind.
Surely in this is a Sign: but most of them do not believe.
And surely your Lord is He, the Exalted in Might, Most Merciful.

Surah 36 verse 13-32 (concerning three Prophets of Allah; Sodom?)
Set forth to them, by way of a parable, the (story of) the Companions of the City. Behold! there came apostles to it.
When We (first) sent to them two apostles, they rejected them: But We strengthened them with a third: they said, "Truly, we have been sent on a mission to you."
The (people) said: "You are only men like ourselves; and (Allah) Most Gracious sends no sort of revelation: you do nothing but lie."
They said: "Our Lord knows that we have been sent on a mission to you:
"And our duty is only to proclaim the clear Message."
The (people) said: "for us, we augur an evil omen from you: if you do not desist, we will certainly stone you. And a grievous punishment indeed will be inflicted on you by us."
They said: "Your evil omens are with yourselves: (deem you this an evil omen). If you are admonished? Nay, but you are a people transgressing all bounds!"
Then there came running, from the farthest part of the City, a man, saying, "O my people! Obey the apostles:
"Obey those who ask no reward of you (for themselves), and who have themselves received Guidance.
"It would not be reasonable in me if I did not serve Him Who created me, and to Whom you shall (all) be brought back.
"Shall I take (other) gods besides Him? If (Allah) Most Gracious should intend some adversity for me, of no use whatever will be their intercession for me, nor can they deliver me.
"I would indeed, if I were to do so, be in manifest error.
"For me, I have faith in the Lord of you (all): listen, then, to me!"
It was said: "Enter you the Garden." He said: "Ah me! Would that my People knew (what I know)!
"For that my Lord has granted me Forgiveness and has enrolled me among those held in honour!"
And We sent not down against his people, after him, any hosts from heaven, nor was it needful for Us so to do.
It was no more than a single mighty Blast, and behold, they were (like ashes) quenched and silent.
Ah! Alas for (My) Servants! There comes not an apostle to them but they mock him!
See they not how many generations before them we destroyed? Not to them will they return:
But each one of them all - will be brought before Us (for judgment).

I have left the verses of stoning in the context they were written. Many nations rejected the Word of Allah and wanted to stone the very Prophets He sent to them. They rejected Allah and so do the propagators of falsehood, namely Sharia, who left us with obscene act after obscene act that the indoctrinated adhere to in direct opposition to the clear teachings of the Quran. Where is the “Quran and Sunnah” when Sunnah is followed and not the former?

Surah 7 verses 177-179
Evil as an example are people who reject Our verses and wrong their own souls.
Whom Allah guides, he is on the right path: whom He rejects from His guidance, such are the persons who perish.
Many are the Jinns and men we have made for Hell: They have hearts wherewith they understand not, eyes wherewith they see not, and ears wherewith they hear not. They are like cattle, no, they are more misguided: for they are heedless (of warning).
